Purpose
1. By using this service, you agree to allow iBlogBarn.com to store and make available your website via the World Wide Web.
Trial Period Offers
1. You may have received a limited time of free service or some other trial period offer. Unless we notify you otherwise, if you are participating in any trial period offer, you must cancel the service by the end of the trial period to avoid incurring charges. If you do not cancel your service, and we have informed you that the service will automatically be converted into a paid subscription at the end of the trial period, then you authorize us to charge your payment method for the service.
Refund Policies.
1. Unless otherwise provided by law, all charges are non-refundable.
2. We may cancel or suspend your service at any time. Our cancellation or suspension may be without cause and/or without notice. Upon service cancellation, your right to use the service stops right away. Once the service is cancelled or suspended, any data you have stored on the service may not be retrieved later. Our cancellation of the service will not alter your obligation to pay all charges made to your billing account.
Liability
1. iBlogBarn.com is not liable for any damages related to the use of this system.
2. iBlogBarn.com does not make any guarantees, either written or implied, as to the usability or availability of this service for any purpose. We provide the service "as-is," "with all faults" and "as available." We do not guarantee the accuracy or timeliness of any information available from the service. We give no express warranties, guarantees or conditions. We exclude any implied warranties including those of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.
3. iBlogBarn.com will not be held liable in any manner for loss of data resulting from the use of this system.
4. iBlogBarn.com does not accept any liability based on the content posted on any member's website.
5. You can recover from iBlogBarn.com only direct damages up to an amount equal to your service fee for one month. You cannot recover any other damages, including consequential, lost profits, special, indirect, incidental or punitive damages.
6. Claim Must Be Filed Within One Year.
Any claim related to this contract or the service may not be brought unless brought within one year. The one-year period begins on the date when the claim first could be filed. If it is not filed, then that claim is permanently barred. This applies to you and your successors. It also applies to us and our successors and assigns.
Prohibited Activities
1. You will not use any services provided by iBlogBarn.com in any manner which is illegal in your locality, or would be considered illegal according to the laws of the state of Illinois, or the United States of America.
2. You will not infringe on the intellectual property of others.
Please respect the rights of artists and creators. Content such as music, photos and video may be protected by copyright. People appearing in content may have a right to control use of their image. You may not share other people?s content unless you own the rights or have permission from the owner.
3. You will not use intellectual property belonging to iBlogBarn.com for any purpose unless given permission to do so.
4. You will not use intellectual property belonging to UserLand Software, Inc. for any purpose unless given permission to do so.
5. You must clearly state the web author's name and e-mail address in the signup process.
6. You may not violate intellectual property rights. In general, anything created or written by another person is copyrighted, even if there is no copyright symbol or other indication of copyright. Copyrighted works must not be included in a Web site without first obtaining permission from the copyright owner.
7. You must adhere to all federal, state, and local laws governing electronic and other forms of publication.
8. You must not violate the federal Communications Decency Act of 1996 and other applicable federal, state, and local laws.
9. You will not use any portion of the service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages (?spam?);
Rights
1. You may discountine use of this service at any time for any reason. Please contact us to have your site removed.
2. All membership data gathered on your site will be stored separately from iBlogBarn.com membership data.
3. iBlogBarn.com reserves the right to deactivate your membership or website, at any time, with or without advance notice for any reason.
4. iBlogBarn.com reserves the right to make changes to this service, at any time, with or without advance notice.
5. iBlogBarn.com retains ownership of its copyrighted material.
6. UserLand Software, Inc. retains ownership of its copyrighted material, including the look and feel of the software used to create and edit the member site, and any graphics created by UserLand Software, Inc. which appear on the site
Privacy
1. We consider your use of the service to be private. However, we may access or disclose information about you, your account and/or the content of your communications, in order to: (1) comply with the law or legal process served on us; (2) enforce and investigate potential violations of this contract; including use of this service to participate in, or facilitate, activities that violate the law; or (3) protect the rights, property, or safety of Microsoft, its employees, its customers or the public. You consent to the access and disclosures outlined in this section.
2. We may use technology or other means to protect the service, protect our customers, or stop you from breaching this contract. These means may include, for example, filtering to stop spam or increase security. These means may hinder or break your use of the service.
3. In order to provide you the service, we may collect certain information about service performance, your machine and your service use. This data will not personally identify you.
